GENERAL TERMS AND CONDITIONS
–19 th Harley-Davidson Open Road Fest –
These General Terms and Conditions (hereinafter Terms and Conditions) regulate the legal relations between the individual participants (hereinafter referred to as the Visitors) and the Organizer in connection with the 19th Harley-Davidson Open Road Fest (hereinafter the Festival) to be organized in the Európa Kemping in Alsóörs by the H-Budapest Limited Liability Company (head office: 1112 Budapest, Neszmélyi köz 3., Business Register No. 01-09-679390, Tax Number: 11844433-2-43, hereinafter referred to as the Organizer).
The provisions of these Terms and Conditions will be accepted as binding by both the Organizer and the Visitor from the time of ticket purchase to the Festival – either by purchasing or by acquiring the tickets in other ways (hereinafter referred to as ticket purchase).
1. Personal, territorial and temporal scope of these Terms and Conditions
1.1. The requirements of these Terms and Conditions apply to both the Organizer and the Visitors in the whole Festival area.
1.2. The scope of the Terms and Conditions is valid from the moment of ticket purchase until the end of the Festival, and covers the rights and obligations arising during that period.
1.3. The Organizer undertakes that Visitors will be fully informed of the provisions of these Terms and Conditions, by posting it on the web site www.openroadfest.hu. In addition, the prevailing Terms and Conditions will also be on display in a prominent place in the Festival area.
1.4. The Organizer shall be entitled to unilaterally amend these Terms and Conditions. Any changes shall be displayed by the Organizer on the website www.openroadfest.hu. Any modifications of the Terms and Conditions are effective from the moment they are published on the website.
2. The Festival
2.1. The organization rights for the Festival are wholly owned by the Organizer.
2.2. The Organizer, as the sole owner of program organization rights, is entitled to change the composition of the programs at its discretion and at any time.
2.3. The Organizer shall display the current program plan for the festival on the website www.openroadfest.hu in each case.
2.4. The Organizer is obliged to ensure the entry and the stay at the Festival for Visitors having a valid ticket, if the Visitor fulfills the obligations laid down in these Terms and Conditions and exercise his/her rights in accordance with these Terms and Conditions and with the current legislation.
3. Visitors’ obligations
3.1. Visitors shall observe the provisions detailed in Section 4 of these Terms and Conditions for the safe and professionally successful performance of the Festival.
3.2. By purchasing a ticket, the Visitor shall acknowledge and be bound by the provisions of these Terms and Conditions.
3.4. Any breach of the obligations contained in these Terms and Conditions allows the Organizer to ban the Visitor from all or part of the duration of the Festival. In such cases, the Organizer is entitled to remove the Visitor from the Festival area within the limits and by the methods imposed by the applicable law.
3.5. To the request of the Organizer or his representative, the Visitor shall immediately cease all conducts that are illegal or are in conflict with the provisions of these Terms and Conditions, and leave the Festival site immediately. In the unlikely event when the Visitor does not fulfill this obligation, the Organizer is entitled to take the necessary steps to ensure the smooth operation of the Festival and to ensure the undisturbed enjoyment of other visitors, within the framework of relevant legislation and, where appropriate, with the help of law enforcement agencies.
4. Rules to be followed
4.1. The Visitor is only entitled to visit the Festival having a ticket that has been purchased from one of the authorized ticket sellers listed in Section 6 of these Terms and Conditions.
4.2. Visitors can only participate in the Festival with a valid ticket and armband.
4.3. When entering the Festival, Visitors shall follow the access control requirements of security guards on duty.
4.4. Drugs, pyrotechnics, flammable materials, weapons, sharp items, limb threatening devices (baseball bat, pepper spray, baton, etc.), alcoholic beverages, as well as food that has not been purchased in the Festival area are not allowed to be brought into the Festival area.
4.5. Consumption of alcoholic beverages is prohibited for Visitors who are under the age of 18.
4.6. A Visitor is permitted to carry one pack/20 pieces of cigarette or one (1) package of tobacco at the time of entry.
4.7. Visitors are required to meet the basic standards of conduct. Drunk or aggressive behavior is not allowed in the Festival area and beyond.
4.8. The Visitor acknowledges that persons performing personal and property defense activities (personnel and security guards) will be acting on the whole Festival area, who are entitled to do so based on Act CXXXIII of 2005 on the rules of private security and private investigation activities as well as within the frames provided by other legislation standards.
4.9. The Organizer will take immediate actions against vandalism to get compensation for the damages caused by the wrongful acts of the Visitor(s) at the Festival site.
4.10. The violation of the provisions of Sections 4.4 to 4.10 of these Terms and Conditions is a serious breach of agreement which allows the Organizer to ban the Visitor from the Festival for a partial or the whole duration.
5.1. Only tickets bought from resellers listed in Section 6 of these Terms and Conditions, or purchased directly from the Organizer entitle the Visitor to enter the Festival.
5.2. Tickets to the Festival can be purchased on-line and in a traditional way. When Visitors purchase tickets on-line, the voucher sent to them by the contractual partner after payment will serve as a ticket
5.3. Tickets are transferable, as long as they are not exchanged for armbands.
5.4. The Organizer shall not be held liable for damages resulting from the loss or the damage of tickets, provided that it occurred not due to his direct fault.
5.5. At the time of purchasing the ticket and by paying the ticket price, the Visitor acknowledges that he has received preliminary information on available ticket types. This means that the Organizer shall not be required to take back or replace tickets with other types free of charge after the purchase.
5.6. The Organizer reserves the right to change the prices of the tickets, and the new price becomes effective without advance notice from its publication on the website www.openroadfest.hu. For ticket prices, always the price list published on the website www.openroadfest.hu is valid.

7. Entering the Festival
7.1. Visitors with damaged, re-glued or outstretched armbands are not allowed to enter the Festival area.
7.2. The Festival area can be used by car only with a permit issued by the Organizer or by the competent authorities.
7.3. To ensure the peaceful entertainment of people, no pets of any kind can be brought into the Festival area.
7.4. Persons under the age of 14 may only enter the Festival area under adult supervision.
7.5. Visitors may take photographs on the Festival area if they intend to use the footage for private purposes.
7.6. Any video recordings to be made on the Festival programs and area shall be authorized in advance in writing by the Organizer.
7.7. During the Festival, photos and videos of the event will be captured by the Organizer, on behalf of him or with his approval, in order to memorize the good atmosphere of the event. Every visitor who enters the Festival area, approves by purchasing a ticket that he/she may appear in such video and image recordings.
8. Requirements to protect the Festival area
8.1. Any wrongful act or omission by the Visitor causing any kind of harm to the Festival area constitutes a serious breach of contract. In addition to bans from the Festival, the Organizer will also initiate immediate legal action for compensation of the damages.
9. Security services and first aid
9.1. For the health and safety of Visitors, the Organizer will provide qualified security guards and doctors giving emergency services. Every Visitor is required to cooperate with these individuals, if for any reason he/she comes into contact with them. The instructions of security guards and doctors on duty serve the successful running of the Festival, therefore they are mandatory for Visitors.
9.2. Social and health insurance is required for health care, the lack of which – with the exception of emergency care – will relieve doctors from their obligations to provide heath care.
10. Business activities in the Festival
10.1. Business activities in the Festival area (sale of products, provision of services, ticket sales, etc.), are only allowed with the prior written permission of the Organizer. The Organizer is entitled to ban persons making unauthorized business activities from the Festival with immediate effect, and also to legally enforce his claims in relation to such unlicensed activities.
10.2. Drunk persons and those who have not yet reached the age of 18, shall not be served with alcoholic beverages on the Festival area.
10.3. Despite the written permission of the Organizer, no business activities must be done in the festival area that harm public interests or are in conflict with the law.
11. Miscellaneous and final provisions
11.1. The legal relationship established by the ticket purchase and regulated by these Terms and Conditions may be terminated with immediate effect by the Organizer at any time, if the Visitor does not comply with or breaches the provisions set out in Section 3 and 4 of these Terms and Conditions. In this case, the Visitor is not entitled to any damages or claims.
11.2. The Organizer reserves the right to unilaterally change the Festival program and its location.
11.3. If any of the Parties can not meet a contractual obligation due to war, rebellion, terrorism, strike or movements that do not qualify as strikes, import or export embargoes, accident, fire, blockade, flood, natural disaster, severe storms, severe energy supply disruption, severe traffic interference/obstruction, order of authorities, or other unforeseen and is unpreventable obstruction with a result that falls beyond the control of the Visitor or the Organizer, then that Party shall not be held liable for any loss or damage which came as a result of these events.
11.4. For questions not settled by the present Terms and Conditions, the applicable law of Hungary shall prevail, especially the provisions of Act IV of 1959 of the Civil Code.
11.5. In case a dispute arises between the Visitor and the Organizer with regard to these Terms and Conditions or in connection with the Festival, the parties agree to attempt to settle their disputes peacefully, in an amicable way. If this is unsuccessful, the parties shall turn to the authorities and courts of jurisdiction of Hungary, or must defer to the Hungarian law.
